AFFILIATE FUTURE SERVICE AGREEMENT

DEFINITIONS
“Client” means a third party that is making a cost per action marketing program available to You via AffiateFuture.com Service “Link” means a hyperlink placed on Your website or newsletter that when clicked on serves a Client’s website to an end-user’s web browser.

THE SERVICE
AffiliateFuture.com has developed and operates a service called AFFILIATE FUTURE (the "Service") which allows web sites to run and/or participate to carry advertising from AffiliateFuture.com clients on a cost per action basis.

CHANGES TO THE SERVICE
AffiliateFuture.com reserves the right to change, modify, add or remove portions of this Agreement at any time and may add to, change, suspend or discontinue any aspect of the Service at any time. In either such case AffiliateFuture.com will notify You via e-mail, newsletter or its website of such changes, at which time You may either agree to such changes or withdraw from the Service.

YOUR RESTRICTIONS
Your account with AffiliateFuture.com may be terminated at any time by AffiliateFuture.com if You are involved in any of the following:
1. Publishing of misleading content
2. Publishing or distribution of content that is either illegal, of an adult nature of morally objectionable
3. Popping up AffiliateFuture.com Links from either your website or newsletter
4. Participating in any form of click fraud
5. Participating in any marketing activity that either breaches copyright / trademark regulations or breach any specific marketing restrictions published on the AffiliateFuture.com website
6. Participate in any form of unsolicited marketing (ie. SPAM)
7. Use of any type of spyware, adware, mallware or any other similar program
8. You must be over the age of 18 to become an affiliate.
If Your account is terminated for any of the reasons above, You forfeit any balance in your account.

US SANCTIONS
AffiliateFuture may not accept affiliates based in any country sanctioned by the US government.

AFFILIATE TRAFFIC
All merchants on AffiliateFuture Inc. will only accept US traffic unless noted otherwise.

NON DISCLOSURE
You agree to keep all information the You receive whilst using the AffiliateFuture.com service confidential.

NONASSIGNABILITY
Neither the rights nor the obligations arising under this Agreement are assignable or transferable by You, and any such attempted assignment or transfer shall be void and without effect. AffiliateFuture.com may assign this Agreement to any successor, affiliate or assign.

COMMISSION PAYMENTS AND FEES
An AffiliateFuture.com Client has the right to cancel any commission payment to you within 5 days of the transaction occurring, for reasons including, but not limited to, an order/lead being incomplete, fraudulent, or otherwise invalid. Any cancelled transactions will be removed from your account immediately. Any commissions earned will not normally be reversed after the 5 day cancellation period, however in exceptional circumstances transactions may be cancelled by AffiliateFuture.com and you will be informed by email of the reason for cancellation. Your commission payment for the month will be calculated on or after the 5th day of the calendar month following the month in which the commissions were earned. An invoice will be raised and will be made available for download from AffiliateFuture.com’s web site. Payments will be made on or around the 14th day of each month. You will be paid if you have supplied the following information IN FULL:
1. full name
2. company name (if appropriate)
3. full address
4. full bank account details.
The minimum payment amount is USD40 and any commissions earned will be carried forward if any of the above conditions is not met. AffiliateFuture.com reserve the right to withhold payment for any reason including, but not limited to, suspicion of fraudulent activity. Monies credited to Your account does not accrue interest.

TERM AND TERMINATION
This Agreement shall remain in effect until terminated. As an Affiliate this Agreement may be terminated by AffiliateFuture.com or You for any reason or no reason upon five (5) days prior e-mail or written notice, or immediately upon notice of any breach of the provisions of this Agreement. Upon termination, You shall no longer be entitled to use the Service.

LIMITED LIABILITY
You are responsible for ensuring that You abide by any local, state, federal or foreign tax laws that may apply to payments that You receive from AffiliateFuture.com. You understand the You may be required to complete Internal Revenue Service (“IRS”) tax information reporting forms prior to receipt of any payments from AffiliateFuture.com. In addition, You understand that AffiliateFuture.com may be required to provide information regarding your earnings to the IRS or any other foreign government agency that requests such information.

LIMITED WARRANTY
The Service, its operation, its use and the results of such use shall be performed in a workmanlike manner. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, AffiliateFuture.com DISCLAIMS ALL WARRANTIES EXPRESS OR IMPLIED, IN RELATION TO THE SERVICE, ITS USE AND THE RESULTS OF SUCH USE. WITHOUT LIMITING THE FOREGOING, AffiliateFuture.com SPECIFICALLY DISCLAIMS ANY WARRANTY (A) THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, (B) THAT DEFECTS WILL BE CORRECTED, (C) THAT THERE ARE NO VIRUSES OR OTHER HARMFUL COMPONENTS AffiliateFuture.com will make reasonable efforts to keep its tracking service operational at all times. However, You acknowledge and accept that it is normal to have a certain amount of system downtime and You may hold neither AffiliateFuture.com or its Clients responsible for any consequences to such interruptions.

REPRESENTATIONS
AffiliateFuture.com makes no representations whatsoever about any other web site which you may access through the Service. In addition, a link to a non-AffiliateFuture.com web site does not mean that AffiliateFuture.com endorses or accepts any responsibility for the content or the use of such Web site.

FORCE MAJEURE
Neither party shall be liable hereunder by reason of any failure or delay in the performance of its obligations hereunder on account of strikes, shortages, riots, insurrection, fires, flood, storm, explosions, acts of God, war, governmental action, labour conditions, earthquakes or any other cause which is beyond the reasonable control of such party.

LEGAL TERMS
The Laws of Delaware govern this agreement at all times. All parties are bound to the jurisdiction of the Delaware Courts for the settlement of any disputes or claims that arise from participation in this service or in connection with this agreement

AFFILIATEFUTURE INC., PRIVACY AND SECURITY POLICY
AffiliateFuture.com recognizes the importance of your privacy. As such we strictly work within the confines of US legislation to ensure that your information is kept secure.

COOKIES
AffiliateFuture.com cookies do not hold any personally identifiable information and are used purely for tracking purposes.

INFORMATION SHARING
AffiliateFuture.com is the sole owner of the information collected on this website. We only share information that is necessary to fulfill the needs of this business. We will not disclose or divulge this information to anyone not affiliated with AffiliateFuture Inc., and its other companies unless required to do so by law.

SECURITY POLICY
AffiliateFuture uses secure server software (SSL) to ensure that your credit card will be protected against fraudulent use while on our site. This service encrypts all personal information entered to prevent anyone but the intended recipient from viewing or manipulating your information.
